Application and Binding Nature of General Terms and Conditions
By validating your order on the site, you acknowledge your awareness of these general terms and conditions of sale and declare that you accept them to the exclusion of any other documents that are strictly for informational purposes.

Cancellation or inapplicability of any of these conditions does not imply cancellation of any of the other clauses, which remain valid and applicable whatever the circumstances.

Any deviations from these general terms and conditions will not take effect unless expressly agreed to in advance by the vendor. An express deviation from any of the these terms and conditions does not imply a waiver in the application of any of the other clauses.
General Information
The products delivered by the vendor shall originate directly and exclusively with authorised manufacturers and suppliers.

The vendor shall only sell contact lenses that have been prescribed by an eye care specialist.

By confirming your order, you explicitly agree and acknowledge that you have a valid prescription from an ophthalmologist or optometrist in accordance with the laws in effect in the country of the purchaser.

It is your responsibility to have your eyes examined regularly by a specialist, to scrupulously adhere to the instructions for the correct use of your contact lenses and products, and to observe strict guidelines of hygiene.

If you experience any unexplained discomfort, tearing, changes in vision, or redness when inserting the lenses, you must remove them immediately and promptly contact an eye care specialist, before reinserting the lenses.
Orders
Information provided by the purchaser when placing an order is binding on the individual. The vendor may not and cannot be held liable for the inability to deliver the product owing to errors in entering the name and address of the recipient. Should the product be returned, all handling costs for repeat shipments will be born by the purchaser.

Orders are not final until confirmed through the receipt by the vendor of the full purchase price. Once payment has been received, the purchaser may not modify or cancel the order, and there are no refunds of the purchase price.

Product offers are subject to the availability of stock. If an item is currently out of stock, the vendor shall inform the purchaser by email within three working days. In this case, purchasers may modify their orders by email.

The vendor reserves the right to cancel any order with purchasers with whom there has been a prior legal dispute.
Delivery
Orders are handled and shipped from Belgium Monday through Friday, excluding holidays, within six working days dating from receipt of the order, based upon the availability of stock.

If payment is made via a bank transfer, the processing period prior to the date of shipment does not begin until the date payment is received.

There will be no compensation for possible shipping delays, and orders being processed may not be cancelled.

The vendor shall not be held liable for any delays in shipment and/or non-delivery in instances of force majeure or any events beyond its control which render execution of the current agreement impossible or overly onerous in full or in part, nor shall it be held liable for the actions of third parties, including suppliers of components of the product, sub-contractors, agents, representatives or shippers, or for the failure on the part of the purchaser to fulfil his or her commitments.

The following are considered to constitute force majeure releasing the vendor of the obligation to deliver the product: war, riots, fires, strikes, and accidents as well as the inability to obtain supplies. The vendor shall inform the purchaser in a timely fashion should any of the above events or emergencies arise.

Under all circumstances, delivery within the given time frame can only occur once purchasers have met their obligations to the vendor.
Forms of Payment
Purchasers may remit payment on line using a credit card or through a bank transfer.

The vendor accepts the following credit cards : VISA and EUROCARD/MASTERCARD.

Prior to handling the order, the validity of the credit card shall be validated by OGONE e-Commerce which will then allocate the amount of the order to a reserve.

The payment system is operated by OGONE e-Commerce, a company specialising in secure Internet payment. OGONE e-Commerce guarantees the complete confidentiality of your personal payment data by using the SSL security protocol which automatically verifies the validity of access right for credit card payments, and by encrypting all information exchanges (See www.ogone.com). Exchanges of sensitive information such as credit card numbers take place between the purchaser and OGONE e-commerce. Thus, at no time does the vendor have knowledge of the purchaser’s credit card number.

The Ogone website is protected by various firewall systems and protocol conversions that bar access by intruders to payment data or payment processors.
Prices – Shipping Costs
Prices listed on the website are denominated in euros and include the 21% VAT (value-added tax).

A detailed invoice in euros which includes the 21% VAT is sent with every shipment.

Shipping and handling costs (packing and freight charges) are added to the price of the order.

Shipping fees are as follows:
Belgium:
€ 4.60 standard shipping 2kg maximum
€ 9.20 standard shipping > 2kg

Europe:
350g maximum : € 6.80/ registered first-class € 10.00 €
1 kg maximum: € 9.80/ registered first-class € 14.20 €
2 kg maximum: € 18.80/ registered first-class € 24.20 €
5 kg maximum: € 26.00

Other locations worldwide:
1 kg maximum: € 15.80
5 Kg maximum: € 52.00

GLS Express: 2 to 6 days, the price is generate on the end of your buy.

Restrictions: GLS deliveries are made during office hours and are subject to acknowledgement of receipt, hence a delivery address where the client is sure to be able to receive the packaging during these times must be specified.

Should a client fail to take delivery of a package when this arrives, the COMPANY shall not arrange for the reshipment of the package until the client has remitted the reshipment costs. Should the client fail to do this within 15 days after requested to do so by the COMPANY, the latter may regard the sale as cancelled, detrimentally and adversely to the client and retain any sums it might have already received by way of compensation.

Shipping fees are added to the charges at the time of the order.
Returns
The purchaser may return the product to the vendor within 14 days, after providing notification via email at the following address: info@1optical.com

Lens care products, lenses or other articles with breakage, which have been opened, or in which the packaging is damaged may under no circumstances be refunded.

A copy of the invoice must accompany any items being returned.

Returned items must be sent by registered mail to the following address: 85 rue Grande, B-5537 Anhee, BELGIUM

The purchaser will be reimbursed within eight days following verification of the merchandise, exclusive of shipping and handling fees.
Litigation – Assignment of Jurisdiction
These general terms and conditions are subject to Belgian law.

Claims and disputes shall be examined thoroughly, and individuals presenting their arguments shall be assumed to be acting in good faith.

In case of a legal dispute, the purchaser shall first seek an amicable settlement with the vendor.

Failing this, only the courts in the districts of Dinant, Namur or Charleroi (Belgium) shall have jurisdiction.
Confidentiality
The vendor guarantees the confidentiality of the purchaser’s personal data which under no circumstances shall be transmitted to a third party.

Purchasers may at any time access, modify, or delete information that they have provided and which pertains to themselves simply by sending a request to the vendor.

The vendor shall strictly follow all regulations relating to the protection of data of a personal nature.
